Brian Richard Fitzgerald, a deputy attorney general for New Jersey, has been arrested on felony charges involving AI-generated child sexual abuse material (CSAM). Bucks County Detectives announced the arrest on Thursday, highlighting a rare case involving a high-ranking legal official tasked with upholding the state's laws.

The Investigation and “thegentlemanpervert”

The case was triggered in July following a tip to the National Center for Missing and Exploited Children (NCMEC) regarding an illicit image shared by a Discord user. Using digital forensics and IP address tracking, law enforcement traced the activity to Fitzgerald’s home address.

Investigators allege that Fitzgerald operated under the Discord handle “thegentlemanpervert_2160_07833.” During a search of his residence, authorities recovered chat logs where Fitzgerald purportedly admitted to creating and sharing multiple illicit images. Furthermore, detectives found the specific prompts and scripts used with an AI program to transform real social media photos of minors into sexualized content.

Legal Context and AI CSAM Classification

Fitzgerald, who had served as a state prosecutor focusing on insurance fraud since 2016, faces charges of possession of CSAM, dissemination of CSAM, and criminal use of a communication facility. New Jersey’s District Attorney, Joe Khan, emphasized that the state views AI-generated material with the same severity as traditional CSAM, following guidelines established by the U.S. Department of Justice in 2024.

  • The DOJ clarified in 2024 that “CSAM generated by AI is still CSAM.”
  • Fitzgerald allegedly used social media photos of real minors as the basis for AI manipulation.
  • This case follows similar recent arrests of law enforcement officers in Pennsylvania and South Korea for AI-related crimes.

“No one is above the law, least of all someone entrusted with upholding it,” Khan stated, asserting that his office would pursue the case aggressively regardless of the defendant's professional title.
